1. About the Website
1.1. Welcome to www.doyoumind.net (the “Website”). This Website provides information about the psychological counselling and assessment services offered by Do You Mind (the “Services”), as well as access to relevant resources, articles, and contact information (the “Content”).
1.2. The Website is operated by Do You Mind ABN 46809404450 (“the Practice”). Accessing or using this Website, or any of its Services, constitutes your agreement to these Terms. Please read them carefully. If you do not agree with these Terms, you should stop using the Website or accessing Services immediately.
1.3. The Practice may update or amend these Terms from time to time at its discretion. Any changes take effect immediately upon being published on the Website, so please check this page regularly for updates.
​2. Acceptance of Terms
2.1. By continuing to use the Website, booking an appointment, attending a session, or making a payment, you acknowledge that you have read, understood, and agreed to these Terms.
2.2. In some cases, you may be asked to confirm your acceptance of the Terms through a digital or written acknowledgment, such as clicking “accept” in the online booking system or signing a consent form.
3. Bookings and Cancellation Policy
3.1. Appointments for the Services may be made by telephone, email, or through the online booking system. You are responsible for paying the session fee (the “Fee”) at the time of each appointment. The Practice reserves the right to request prepayment for initial or assessment sessions.
3.2. You must notify the Practice of any intention to cancel or reschedule through email to hello@doyoumind.net. The following cancellation conditions apply (“Cancellation Policy”):

Cancellations made with at least 48 business hours’ notice: no fee will be charged.

Cancellations made within 48 business hours of your scheduled appointment: 50% of the session fee will be charged.

Cancellations made within 24 business hours, arriving more than 25 minutes late, or non-attendance without notice: 100% of the session fee will be charged.
3.3. Cancellation fees are not claimable through Medicare or private health insurance.
3.4. Repeated cancellations or non-attendances may result in review of ongoing suitability for services or the requirement for prepayment of future sessions.
4. Fees and Payment
4.1. Fees for sessions are determined by the Practice and may vary depending on the service provided. Clients will be advised of the applicable fee prior to booking and notified of any future fee adjustments.
4.2. Payment is required on the day of the appointment unless alternative arrangements have been agreed upon in advance. Payments are processed securely through the Practice’s booking system, STRIPE, and may be made by EFTPOS, credit card, or direct bank transfer. For plan-managed NDIS participants, invoices will be issued directly to the nominated plan manager after each session in accordance with the NDIS Price Guide.
4.3. Medicare rebates, where applicable, are processed after full payment is received. Private health insurance rebates are the responsibility of the client; the Practice will provide an itemised receipt to assist with claiming.
4.4. Accounts not settled within the required timeframe may result in future appointments being cancelled and offered to other clients until payment is received.
4.5. Unless otherwise stated, all amounts are listed in Australian Dollars (AUD). Psychological services provided for the purpose of diagnosing, treating, or supporting mental health and wellbeing are GST-free in accordance with the A New Tax System (Goods and Services Tax) Act 1999 (Cth). Fees for non-clinical services (such as supervision, training, or consultancy) may attract GST. Psychological sessions and letters/reports billed to the NDIS are GST-free when provided as part of clinical therapy or to support a participant’s disability-related goals. Non-clinical reports, including medico-legal or employment assessments, may attract GST.
5. Late Arrivals
Sessions cannot be extended beyond the scheduled time. If you arrive late, the session will still end at the scheduled time, and the full Fee will apply.
6. Service Use and Limitations
6.1. Psychological services provided by the Practice are professional health services intended to support mental well-being. They are not a substitute for emergency or crisis services.
6.2. If you are in crisis, at risk of harm, or require immediate assistance, you should contact emergency services (000), Lifeline (13 11 14), or the Mental Health Line (1800 011 511).
6.3. The Practice reserves the right to refer you to more appropriate services if your presenting needs exceed the scope of care available within the Practice. Referrals may be made based on factors including, but not limited to:

Whether the clinician has the appropriate training, qualifications, or experience to provide the required care;

Whether other services are available that offer more specialised expertise or treatment for your needs;

Waiting lists or availability constraints that may affect timely access to care;

Clinical case load management, to ensure safe and effective care for all clients; or

Any other factors deemed relevant to ensuring that you receive the most appropriate and effective care.
6.4. The Practice will endeavour to assist in identifying and connecting clients with alternative providers or services when a referral is necessary.

7. Privacy and Confidentiality
7.1. The Practice takes your privacy seriously. All personal information collected is handled in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles, and the APS Code of Ethics.
7.2. Information shared in sessions remains confidential except where disclosure is required or authorised by law (e.g., risk of harm to self or others, court orders, or mandatory reporting obligations).

8.1. The information and materials on the Website are provided for general information purposes only and do not constitute psychological advice or replace individual professional consultation.

11. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales.

Both parties acknowledge that these Terms are fair and reasonable and that each has had the opportunity to seek independent legal advice prior to agreeing to them.
13. Severance
If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed, and the remaining Terms will continue in full force and effect.
